NV charges prison guard in inmate'south shooting death

The NV state attorney common on Monday charged a former prison guard trainee with involuntary manslaughter in the shotgun killing of a handcuffed inmate in a prison hallway in November two thousand fourteen.

Raynaldo-John Ramos is accused of firing the shotgun blasts that killed Carlos Perez Jr. while Perez and another inmate brawled at High Desert State Prison exterior Las Vegas.

The filing in Clark County District Ct also charges Ramos with rash disregard resulting in death. A conviction on both felonies could obtain him up to nine years in prison.

Ramos was dismissed by the NV Dept of Corrections in April two thousand fifteen. Phone calls to a no in Las Vegas associated with him have gone unanswered.

Attorney Common Adam Laxalt said in a statement that he doesn't get lightly charging a state correctional officer, but that prosecutors believed criminal charges against Ramos were warranted.

A spokeswoman for the state prisons dept and its new director, James Dzurenda, declined to comment.

Ramos is believed to be the first former NV prison guard charged with shooting an inmate since Paul Chaffee in two thousand-seventh. Chaffee, who also worked at High Desert State Prison in Indian Springs, was acquitted at trial in Las Vegas in two thousand-eighth of battery with a fatal weapon in the shooting of 22-year-old Donald Hixon.

Two other guards in the Perez shooting, former corrections officers Jeff Castro and Isiah Smith, weren't charged by Laxalt. They resigned latest May after being found by prison executive to have made misleading statements and to have neglected their duties.

NV Dept of Corrections documents made public latest week in a federal wrongful death lawsuit keep most of the blame for the November two thousand fourteen shooting on Castro. He also was found to have used unauthorized force and to have engaged in insubordination and unbecoming conduct for bringing unwanted scrutiny to the NV Dept of Corrections.

Cal Potter, an attorney for Perez'south family, alleges the guards staged a "gladiator-like scenario" pitting Perez against inmate Andrew Arevalo before the inmates were shot. Potter on Monday called the criminal complaint a welcome development but "a half a cup of justice."

"It'south fascinating they charged only the trainee and not the ones who were doing the training and stood by and did nothing to stop it," Potter said. He well-known also that number one was charged with shooting Arevalo.

Perez, twenty-eight, died from multiple gunshot wounds in the Nov. twelve, 2014, shooting in a shower hallway in a prison segregation unit where inmates are supposed to be kept apart for disciplinary reasons or safety.

Arevalo, twenty-five, suffered shotgun wounds to his face and upper body. He'south presently being held at the maximum security state prison in Ely, serving a two-to-six year prison sentence for a two thousand thirteen burglary conviction in Las Vegas.

"Finally," said Arevalo'south lawyer, Alexis Plunkett. "I think they avoided this until the recent release of those records left them with number other choice."

She referred to the federal lawsuits in U. S. District Ct in Las Vegas that title Ramos, Castro and Smith, along with prison administrators and the state.

A criminal conviction for manslaughter and rash disregard against Ramos will require a stricter "beyond a reasonable doubt" standard than a judgment of liability in a civil case, where the burden of proof can set up proportional blame based on a preponderance of the evidence.
